CANFER breaking news

The Environment and Climate Change Canada (ECCC) has amended the Composite Wood Products Regulation for formaldehyde emissions last December 18th, 2024.
 
As stated in the Canada Gazette, Part II, Volume 158, Number 26:
The Amendments
  • provide clarity for regulated parties and reduce the risk of misapplication of the regulations by removing the accreditation requirement for laboratories conducting routine quality control formaldehyde emissions testing;
  • revise record-keeping requirements for all entities along the composite wood products supply chain to reduce unintended burden;
  • maintain the regulations’ close alignment with TSCA Title VI in order to minimize international trade barriers; and
  • make minor amendments to provide clarification on issues brought forward by stakeholders. 
Most of amendments are editorial. The main changes concerns laboratories activity and the declaration of Certification:
  • the laboratory accreditation requirements do not apply to routine manufacturer quality control testing but only to TPCs;
  • the requirement for TSCA Title VI certified Producers to prepare a separate CANFER Declaration of Certification was deleted and TSCA Title VI certificates issued by a TPC are enough; but Producers who are certified only according to CANFER (no TSCA Title VI) have to issue a CANFER Declaration of Certification;
  • notification on non-complying lots has been aligned with TSCA Title VI: the Producer has to notify it to his customer within 72 hours (before amendment was 48 hours)
