
Last month we published a piece of
news in reference to the EU Packaging and Packaging Waste Regulation, which will come into force in August 2026. In these lines we aim to clarify and define some of the deadlines to be met focusing on the role of the producer.
Let us recall the scope of the PPWR:
The regulation applies:
“to all packaging, regardless of the material used, and to all packaging waste, regardless of the context in which the packaging is used or the origin of the packaging waste: industry, other manufacturing, retail or distribution, office, service or household.” -Article 2
Who is the producer-Article 3:
The producer is the manufacturer, importer or distributor:
- who is established in a Member State and makes available for the first time from and on the territory of that Member State:
- transport packaging, service packaging or primary production packaging, either as disposable packaging or reusable packaging; or - who is established in a Member State and who makes available for the first time from the territory of that Member State and on that territory:
- products packaged in packages other than those referred to in subparagraph (a); or - who is established in a Member State or a third country and makes available for the first time within the territory of another Member State, directly to consumers:
- transport packaging, service packaging or primary production packaging, either as single-use packaging or reusable packaging, or products packaged in different packaging; or - who is established in a Member State and makes available for the first time within the territory of another Member State:
- packaging, directly to users of the packaged goods other than those referred to in and subparagraph (c); or - who is established in a Member State and unpacked the packaged goods without being the end user, unless another person is the producer as defined in subparagraphs (a), (b), (c) or (d)."
First Producer Deadlines:
In Chapter VIII, in Article 44 - Producer Registry and Extended Producer Responsibility we find that:
- within 18 months of the entry into force of the first implementing act, each state will establish a national register designed to verify producer compliance with Chapter VIII.
- As of February 12, 2026, the national packaging producer register for each EU country will be released. This register will be provided in Italy by Ministry of Environment and Energy Security.

- The registration and registration number will be provided within a maximum period of 12 weeks from the time when all necessary registration information is provided.

Vademecum on prevention measures and design criteria:
CONAI will provide an operational guidance document that will have for each packaging sustainability requirement: objectives, scope, deadlines, measure content, exemptions and means of proof.
The vademecum will go to public consultation for trade associations and will close on June 20.
